Applicants' advocate Avnish Kumar told the court that on 5 May, 19858 constables have been transferred from one district to another. The applicants' advocate said that the constables have been transferred without any transfer policy.

He told the court that the previous transfer policy was abolished in the year 2022. After this, no new transfer policy has been made till date. Despite this, such a large number of constables appointed between 2010 and 2015 were transferred simultaneously. The court, while accepting the arguments given on their behalf, put a stay on the transfer order for the time being. Also ordered the state government to file a reply affidavit in four weeks. The next hearing on the case will be held after the summer vacation ends.


It is worth noting that the Additional Director General of Police (Headquarters) had released the transfer order of 19858 constables on 5 May.

This transfer action has been taken on the instructions of the Election Commission in view of the Bihar Assembly elections. On Thursday, Additional Director General of Police (Headquarters) Kundan Krishnan released the order related to this. This order will come into effect with immediate effect. Earlier, on May 5, 2025, the Police Headquarters had simultaneously transferred about 20 thousand constables who had completed eight years in the range.


Kundan Krishnan has directed that all the transferred Havildars and ASIs be relieved for contribution from June 1, 2025. At the same time, SIs and equivalent police officers will be relieved within 15 days to join the newly posted district. The ADG has asked to bring the matter to the notice of the concerned IG-DIG if any error is reflected after the transfer.
